Whenever a proposed subdivider files a proposed vesting tentative map for a subdivision whose intended development is inconsistent with the Planning Code, that inconsistency shall be noted on the proposed map. The City may deny such a map based on the inconsistency.
Notwithstanding any other provision of this Article, a property owner or his or her designee may seek approvals or permits for development which depart from the ordinances, policies or standards applicable under Section 1333.3(a), and the City may grant such approvals or issue such permits to the extent permitted by otherwise applicable law.
